Terms of Service

These Terms of Service (“Terms”) govern your use of Dashe’s real estate marketing services, dashboard, and any related software or deliverables (collectively, the “Services”). By signing a proposal, accessing the Dashe dashboard, or making any payment, you agree to these Terms in full. If you do not agree, do not use the Services.

“Dashe”, “we”, or “us” refers to the agency operating under the Dashe brand. “Client”, “you”, or “your” refers to the individual or business accessing the Services.

1. Services

Dashe provides AI-powered real estate marketing services, which may include any combination of the following depending on your plan:

  • Custom real estate agent website, built from our template and configured to your brand
  • AI-generated property listing content including voiceover scripts, social media captions, and blog posts
  • Automated video production (Standard Ken Burns or Cinematic Runway Gen-4 Turbo)
  • Social media carousel generation (Bannerbear)
  • Content scheduling and auto-publishing to connected social channels and your website
  • AI-powered lead qualification via Instagram and Facebook DMs (n8n / ManyChat)
  • Email automations including open house invites, drip campaigns, and sphere-of-influence alerts
  • Administrative workflow automations (Calendly scheduling, sold alerts, just-listed notifications)

Specific deliverables, volumes, and features are defined in your signed proposal. Services not listed in your proposal are not included and may be added for additional fees.

2. Payments & Fees

All Services are subject to a one-time setup fee plus a recurring monthly retainer, as specified in your proposal. Fees are in USD.

  • Setup fee — Due upon signing. Non-refundable once onboarding has commenced (defined as any of: account provisioning, voice cloning, website configuration, or workflow build).
  • Monthly retainer — Billed on the same calendar day each month. Invoices are due within 7 days. Overdue balances accrue a 1.5% monthly late fee.
  • Extra listing packages — Billed at $197 per listing package beyond your plan allocation, invoiced at month-end.
  • Cinematic video upgrade — $250/month add-on for Autonomous Brand-level video on Pulse plans. Runway Gen-4 Turbo per-clip costs ($0.20/4 sec) are included within your monthly allocation; additional clips are billed at cost plus 20%.

We reserve the right to pause or suspend Services for accounts more than 14 days past due. Suspended accounts are not entitled to refunds or makeup deliverables for the suspended period.

3. Minimum Commitments

Given the setup investment on both sides, the following minimum terms apply:

  • Pulse — 3-month minimum commitment
  • Autonomous Brand — 6-month minimum commitment
  • Shadow Founder — 12-month minimum commitment

Early termination within the minimum period will result in a fee equal to 50% of the remaining monthly retainer for the uncommitted months. After the minimum period, either party may cancel with 30 days’ written notice.

4. Content & Approvals

The approval gate is mandatory. Before any audio, video, or published content is produced, you will be presented with the AI-generated voiceover script and captions for review. You must explicitly approve (or edit and approve) before production proceeds. By clicking “Approve”, you confirm the content is accurate, compliant with your brokerage’s policies, and ready for production.

You are solely responsible for ensuring that all content you approve is accurate, compliant with applicable real estate advertising regulations (including RESPA, NAR Code of Ethics, and any state or local MLS rules), and does not infringe on third-party rights.

Dashe is not responsible for regulatory violations, fines, or MLS sanctions arising from content you have approved and published. You are responsible for reviewing all content before approving it.

5. AI-Generated Content

Our Services use AI models (including Anthropic Claude, ElevenLabs, Runway) to generate scripts, captions, voiceovers, and video content. By using the Services, you acknowledge and agree that:

  • AI-generated content may contain inaccuracies or hallucinations, and must be reviewed by you before approval
  • Neighborhood facts, school district data, and market context included in scripts are based on the AI model’s training data and may not be current — verify before approving
  • We do not warrant that AI-generated content is error-free, legally compliant, or suitable for any particular regulatory environment
  • You own all approved and produced content deliverables (see Section 7)

6. Ownership

Upon full payment of all outstanding fees, you own all final deliverables produced for your listings: videos, audio files, carousels, captions, and blog posts. You may use these deliverables in perpetuity for any lawful marketing purpose.

Dashe retains ownership of: all underlying software, pipeline infrastructure, workflow templates, the Dashe platform, and any unreleased work-in-progress. Your website (if included in your plan) is built on a Dashe template — you own the content and domain, but Dashe retains the codebase. Upon cancellation, we will provide you with a full export of your website content and listings data.

Dashe may use anonymized, non-identifying examples of your content for internal product improvement and portfolio purposes unless you opt out in writing.

7. Client Responsibilities

You agree to:

  • Provide accurate property information, MLS data, and listing photos in a timely manner
  • Review and respond to approval requests within 5 business days; delays may affect delivery timelines
  • Provide signed voice cloning consent forms before any voice cloning service commences (see Section 10)
  • Connect your social media accounts with the permissions required for automated publishing
  • Ensure your Meta (Instagram / Facebook) Business account remains in good standing and compliant with Meta’s policies
  • Not use the Services for any unlawful, deceptive, or discriminatory real estate advertising
  • Not resell, sublicense, or white-label our Services without written permission

8. Third-Party Services

Our pipeline depends on third-party platforms including, but not limited to: Anthropic (Claude AI), ElevenLabs (voice synthesis), Deepgram (transcription), Runway (cinematic video), Bannerbear (carousels), Meta (Instagram/Facebook), Resend (email), Calendly, Supabase, Cloudflare, and Vercel.

We are not responsible for service outages, API changes, pricing changes, or policy updates made by any third-party provider that affect delivery timelines or feature availability. We will notify you promptly of any material changes and work to find alternatives where possible.

9. Social Media Limitations

Due to Meta Platform Policy restrictions, the following limitations apply to our social automation services:

  • Instagram comment replies go to DMs, not the public comment thread. When someone comments on a post and triggers an automation, our system responds via Instagram Direct Message — it cannot post a reply directly in the comment thread. This is a Meta API limitation, not a Dashe limitation.
  • Sold post updates: Meta’s API does not allow editing existing published posts. Sold alerts are posted as new content, not edits to the original listing post.
  • Meta App Review for automation features can take 1–4 weeks. Delays in Meta’s review process are outside our control and may delay the launch of DM automation features.

10. Voice Cloning

Voice cloning services require your explicit written consent before commencement. By providing a voice sample and signing the consent form, you confirm that:

  • You are the owner of the voice being cloned and have full rights to authorize its use
  • The cloned voice will be used exclusively for your real estate marketing content produced through Dashe
  • You grant Dashe a limited licence to create and use the voice clone solely for your deliverables
  • Instant Voice Clones (IVC) require a 2–3 minute sample; Professional Voice Clones (PVC) require 30+ minutes of clean audio and 3–6 hours of training time before delivery

Voice clone assets are deleted from our systems within 30 days of account termination.

11. Limitation of Liability

To the fullest extent permitted by law, Dashe’s total liability for any claim arising out of or related to the Services shall not exceed the total fees paid by you in the 3 months preceding the claim.

Dashe is not liable for: lost deals, lost commissions, lost referrals, regulatory fines, MLS sanctions, social media account suspensions, or any indirect, incidental, or consequential damages — even if advised of the possibility of such damages.

You acknowledge that real estate marketing involves inherent uncertainties and that our Services do not guarantee any specific number of leads, showings, offers, or closed transactions.

12. Termination

Either party may terminate the Services after the minimum commitment period with 30 days’ written notice. Dashe may terminate immediately, without refund, if you:

  • Fail to pay any invoice within 30 days of the due date
  • Use the Services for unlawful or deceptive advertising
  • Violate Meta’s Terms of Service in a way that jeopardizes our platform access
  • Engage in harassment or abuse toward Dashe personnel

Upon termination, we will provide you with an export of your content deliverables, listings data, and website content within 14 business days. Access to the Dashe dashboard will be revoked at termination.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of the jurisdiction in which Dashe is registered, without regard to conflict of law principles. Any disputes shall be resolved through binding arbitration before a court of competent jurisdiction in that jurisdiction, except that either party may seek injunctive relief in any court.

We reserve the right to update these Terms at any time. Material changes will be communicated via email with 14 days’ notice. Continued use of the Services after that period constitutes acceptance of the updated Terms.
